By opting into or participating in the text messaging program operated by Skyrocket Pediatric Therapy Foundation ("we," "us," or "our"), you agree to be bound by these Terms and Conditions, our general Website Terms of Use, and our [SMS Privacy Policy].

1. Program Description & Communication Scope

Skyrocket Pediatric Therapy Foundation provides text messaging communications to keep client families, caregivers, and program participants informed. By providing your mobile number and opting in, you authorize us to send text messages regarding:

• Appointment reminders, confirmations, and scheduling modifications.

• Operational announcements (e.g., unexpected clinic closures, weather delays, or holiday hours).

• Intake, onboarding, and program administration updates.

• Direct communications from clinical or administrative staff regarding pediatric therapy services.

By completing an intake form, submitting an online registration, or verbally consenting to join our SMS list, you provide express written consent to receive automated or non-automated text messages from us at the mobile phone number provided.

• Non-Condition of Service: Opting into SMS messaging is completely voluntary. Consent to receive text messages is not a requirement or condition to receive pediatric therapy services, clinical evaluations, or participate in any foundation programs.

3. Message Frequency and Rates

• Message Frequency: Message frequency varies depending on your family's active therapy schedule, intake status, and administrative interactions with our office. You may receive multiple messages per week surrounding scheduled appointments.

• Cost: We do not charge a fee for sending or receiving text messages; however, message and data rates may apply depending on your specific mobile carrier and wireless plan. You are solely responsible for any messaging or data fees charged by your mobile provider.

4. Opt-Out Procedure (Cancellation)

You have the right to revoke consent and opt out of receiving SMS communications at any time:

• How to Opt Out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message received from Skyrocket Pediatric Therapy Foundation.

• Confirmation: Upon sending an opt-out keyword, you will receive a single, final confirmation message verifying that you have been unsubscribed from our text list. No further text messages will be sent unless you re-subscribe.

7. Unencrypted Communications & Privacy Safeguards

Standard SMS text messages are not encrypted. While Skyrocket Pediatric Therapy Foundation limits SMS message content to non-sensitive administrative details (such as appointment dates and times), sending personal information via SMS carries inherent security risks.

• HIPAA Notice: Detailed medical evaluations, clinical diagnostics, or Protected Health Information (PHI) will not be sent via unencrypted SMS.

• Data Privacy: Mobile information, opt-in data, and consent details will never be sold, rented, traded, or shared with third parties or affiliates for marketing or promotional purposes, in accordance with 10DLC regulations and our SMS Privacy Policy.

8. Limitation of Liability & Governing Law

To the fullest extent permitted by applicable law, Skyrocket Pediatric Therapy Foundation shall not be liable for any failed, delayed, or misdirected delivery of any information sent via SMS, any errors in such information, or any actions you take or do not take in reliance on the information.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
