This Release of Liability (the "Release") is entered into on the date this form is signed by and between the undersigned participant's parent or legal guardian ("Releasor") and Skyrocket Pediatric Therapy Foundation, a California nonprofit corporation ("Skyrocket").
Skyrocket Pediatric Therapy Foundation is a nonprofit organization dedicated to providing financial assistance for therapeutic group classes for children. Skyrocket's role is limited to offering financial aid and does not include providing any therapeutic services, instruction, supervision, or involvement in the actual classes.
The therapeutic group classes for which financial assistance is provided (the "Classes") are exclusively organized, provided, and conducted by Brainwaves Pediatric Therapy. Brainwaves Pediatric Therapy is an independent entity and is solely responsible for all aspects of the Classes, including but not limited to the curriculum, instruction, safety protocols, facility, and the qualifications of its personnel.
Release and Waiver
In consideration of Skyrocket Pediatric Therapy Foundation providing financial assistance for the Releasor's child to participate in therapeutic group classes offered by Brainwaves Pediatric Therapy, the Releasor, for themselves and on behalf of their child, heirs, executors, administrators, and assigns, hereby agrees to the following:
Assumption of Risk: The Releasor understands and acknowledges that participation in therapeutic group classes involves inherent risks, including but not limited to physical injury, emotional distress, or other unforeseen consequences. The Releasor voluntarily assumes all risks associated with their child's participation in the Classes.
No Responsibility of Skyrocket: The Releasor expressly understands and agrees that Skyrocket Pediatric Therapy Foundation is not responsible for, and shall not be held liable for, any injury, damage, loss, accident, delay, or irregularity, however caused, arising out of or in connection with the therapeutic group classes provided by Brainwaves Pediatric Therapy. This includes, but is not limited to, any acts, omissions, negligence, or conduct of Brainwaves Pediatric Therapy, its employees, agents, or representatives.
Release and Discharge: The Releasor hereby releases, discharges, indemnifies, and holds harmless Skyrocket Pediatric Therapy Foundation, its directors, officers, employees, agents, and volunteers from any and all claims, demands, actions, causes of action, suits, obligations, liabilities, damages, and expenses (including attorneys' fees) of any nature whatsoever, whether known or unknown, foreseen or unforeseen, that may arise from or in any way relate to the Releasor's child's participation in the Classes provided by Brainwaves Pediatric Therapy.
Acknowledgment of Independent Provider: The Releasor acknowledges that Brainwaves Pediatric Therapy is an independent organization, and Skyrocket Pediatric Therapy Foundation has no control over, or responsibility for, the services provided by Brainwaves Pediatric Therapy. Any issues or concerns regarding the Classes, including but not limited to safety, quality of instruction, or incidents during the classes, must be directed solely to Brainwaves Pediatric Therapy.
Understanding of Agreement: The Releasor confirms that they have carefully read this Release of Liability, understand its contents, and are signing it voluntarily and without any inducement or assurance from Skyrocket Pediatric Therapy Foundation. The Releasor further understands that this Release constitutes the entire agreement between the Releasor and Skyrocket Pediatric Therapy Foundation regarding the matters contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such matters.
